Update on Florida Marijuana Laws 2023

As an update on Florida Marijuana laws, you’ll be pleased to know that medical marijuana is legal in the state of Florida, while recreational use remains unfortunately illegal.

Medical Marijuana

In 2014, Florida approved a law that allows the use of low-THC CBD oil for qualifying patients suffering from specific conditions such as cancer or epilepsy. This law was expanded in 2016 through the passage of Amendment 2, which allowed for the use of higher-THC products and expanded the list of qualifying conditions.

Under this law, patients must have a recommendation from a qualified physician and must register with the state’s Medical Marijuana Use Registry. Registered patients are allowed to purchase medical marijuana from state-licensed dispensaries, also known as Medical Marijuana Treatment Centers (MMTCs).

It’s important to note that while smokable forms of marijuana are allowed, smoking marijuana in public places is prohibited.

Recreational Marijuana

As of September 2021, the recreational use of marijuana is illegal in Florida. Possession of 20 grams or less of marijuana is considered a misdemeanor, which can result in up to a year in jail, a $1,000 fine, and a driver’s license suspension. Possession of more than 20 grams is considered a felony and can result in stiffer penalties.

CBD Oil and Hemp

Hemp and CBD oil containing less than 0.3% THC were legalized in Florida in 2019. CBD products are available over the counter in various forms, including oils, tinctures, edibles, and lotions. However, it’s always important to verify the source of these products to ensure their quality and legality.

Driving Under the Influence

Driving under the influence of marijuana is illegal in Florida. Even registered medical marijuana patients are prohibited from using marijuana while driving or operating a vehicle.

Remember, although medical marijuana is legal in Florida, it is still considered illegal under federal law. Therefore, it’s important to understand and comply with all local and state laws related to the use of marijuana. As laws often change, always check the most current regulations to ensure you are following the most up-to-date guidelines.
